Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 399/402/401/414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. Allegation is that the petitioner and others were apprehended on suspicion that they were going to commit dacoity and from possession of the petitioner fire-arm and live cartridges were recovered.

Learned counsel for the petitioner has stated on oath in para-8 of the petition that in fact petitioner was arrested by the police two days prior to the present FIR and in this case has

He further submits that Annexure-2 is the letter addressed by the local Mukhiya, Sarpanch and others to the Dy. S.P. stating therein that the petitioner has falsely been implicated in this case; rather he was arrested prior to the present FIR. The petitioner is in custody since 10.02.2020.

Considering the aforesaid submission as well as completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sasaram Town P.S. Case No.105 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
