The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.
As per the prosecution case, two accused persons on a motorcycle on the point of pistol robbed the informant of his mobile phone etc.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. His name transpired in the confessional statement of co-accused Jhonson Maurya made before police. No incriminating article has been recovered from his possession. He is in custody since 30.1.2021 and
Patna High Court CR. MISC. No.32270 of 2021(4) dt.10-02-2022 2/2 chargesheet has been submitted in the case.
Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Brahampura P.S. Case no.240 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur.
