Petitioner is in custody in connection with Excise Complaint Case No. 138/2018 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner would submit that petitioner is in custody since 8.10.2018 in connection with recovery of 62.250 liters of wine.

In the past also one similar such case was registered against the petitioner.

Considering the period of custody, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.568 of 2019(2) dt.16-01-2019 2/2 each to the satisfaction of learned Additional District and Sessions Judge-II, Banka, in connection with Excise Complainant Case No. 138 of 2018 on the condition that in future if the name of the petitioner figures in any of such case of Bihar Prohibition Excise Act, the court below shall be at liberty to cancel the bail bonds of the petitioner.
