JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 26-08-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

10 litres of Chulai liquor has been recovered from the gate of the house of the petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is no recovery from the conscious possession of the petitioner and petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is also submitted that the said house is a joint family property.

No.25668 of 2022(2) dt.26-08-2022 2/2 Taking into consideration the fact that liquor has been recovered from the gate of the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Mairwa P.S. Case No.374 of 2020, pending in the court of learned Additional District & Sessions Judge-IInd-cum-Special Judge, Siwan.
