In this case, the petitioner is apprehending his arrest in connection with Pipariya P.S. Case No. 01 of 2017 registered for offences under sections 409 of the Indian Penal Code. The Block Education Officer, Pipariya, the Informant, has lodged the First Information Report making an allegation that the books, which were meant for the students to be supplied, were sold as a waste paper and the persons, who were intercepted, were carrying those books for commercial purpose.

The petitioner is a teacher having been posted in the office of Block Education Officer for the purpose of making allotment of books.

Patna High Court Cr.Misc. No.24897 of 2017 (3) dt.10-08-2017 Learned counsel for the petitioner submits that as on today, the charge-sheet has not been submitted and it is under investigation.

In view of the above, let the petitioner, namely, Anjani Kumar Singh, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Lakhisarai in connection with Pipariya P.S. Case No. 01 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The anticipatory bail is being granted to the petitioner up to the stage of submission of the charge-sheet. If the chargesheet is submitted against the petitioner, the benefit of anticipatory bail granted to the petitioner will be treated to have been withdrawn and the petitioner will have to surrender before the court below.
