JUSTICE RAVI RANJAN ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 354, 379, 504 and 506 of the Indian Penal Code.
It is contended that there is apparent land dispute between the parties and a proceeding under Section 144 Cr.P.C. was also been initiated in which Nand Kishore Paswan, husband of the informant as well as Maheshwar Paswan, cousin grandfather-inlaw of the informant were parties. Both sides are agnates. It is urged that the allegation upon the petitioner of snatching Rs.10,000/- and golden chain etc. is ornamental in nature. The petitioner claims that he is working in the office of Child Development Project on payment of honorarium.
Patna High Court Cr.Misc. No.29649 of 2016 (3) dt.05-09-2016 2/2 Having regard to the facts and circumstances of the case, let the petitioner, namely, Rajesh Kumar @ Rajesh Raushan Paswan be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Muzaffarpur Mahila P.S. Case No.63/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
It is made clear that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
