Case No. 13/2014, wherein offences punishable under section 25(ib)A/26/35 of the Arms Act and other offences were alleged. Apprehending his arrest, the petitioner filed A.B.P. No. 402 of 2014 in the court of Sessions Judge, Aurangabad. The same was rejected on 21-6-2014. Hence, this application. Heard learned counsel for the petitioner and learned A.P.P.for the State.
The allegation against the petitioner is that he has provided shelter to certain extremists. The truth or otherwise needs to be determined in the trial. It is brought to the notice of this Court that three persons, who are found with arms were arrested in the same crime and were granted regular bail. If that is so, the
Patna High Court Cr.Misc. No.36999 of 2014 (4) dt.23-07-2015 2/2 petitioner can also surrender before the court below and move an application for regular bail. If the other accused said to have been holding arms, have been granted regular bail, there is no reason why the petitioner will be denied.
