JUSTICE SANDEEP KUMAR ORAL ORDER 18-05-2023 Learned counsel for the petitioner is permitted to make necessary correction in the present application. Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bihta P.S. Case No.1235 of 2022 for the offence under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got one criminal antecedent and he is in custody since 22.11.2022. He further submits that petitioner is a member of mob.

Learned counsel for the informant has submitted that petitioner is an order giver.

It has been alleged that one person, namely, Mukesh

Patna High Court CR. MISC. No.24121 of 2023(2) dt.18-05-2023 2/2 Kumar assaulted the informant due to land dispute. On 20.11.2022, Mukesh Singh along with other accused came to the house of the informant and fired upon Harendra Verma which caused death. On commotion, the locals gathered then the accused persons fled away.

Considering the fact that the petitioner has got one criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M1st, Danapur in connection with Bihta P.S. Case No.1235 of 2022.
