JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Petitioner is not named in the first information report and for the first time, the name of petitioner came in this case on the basis of information given by spy of the police. Subsequently, witnesses also disclosed the name of petitioner and petitioner too confessed his guilt.

Learned counsel for the petitioner submits that as a matter of fact, the petitioner was earlier made accused in another case and subsequently, police implicated the petitioner

Patna High Court Cr.Misc. No.78814 of 2018(2) dt.18-01-2019 2/2 in the present case also.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Goreakothi P.S. Case No. 05 of 2018.
