In the present case, the petitioner is apprehending his arrest in connection with Paliganj P.S. Case No. 167 of 2016 for offence under Section 47 of the Bihar Excise (Amendment) Act. As per allegation, from the house of Budhan Choudhary, huge quantities of illegal liquor have been recovered. Learned counsel for the petitioner submits that the petitioner was not there nor is anyway connected with the trade of illegal liquor. He further submits that one co-accused, namely, Niranjan Yadav has already been granted bail vide order dated 4.2.2017 passed in Cr. Misc. No. 52 of 2017.

Looking to the entire facts and circumstances of the

Patna High Court Cr.Misc. No.24755 of 2017 (2) dt.10-07-2017 case, let the petitioner, namely, Sahjanand, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Paliganj P.S. Case No. 167 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
