====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Hajipur Town P.S. Case No. 624 of 2018 instituted for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
In the written report it is alleged that informant got information that some unknown persons have caused firearm injury on the abdomen of his son. The informant went to the place of occurrence and took his son to hospital where he was declared dead. Petitioner is not named in the First Information Report. During investigation, the informant in his further statement has disclosed the name of this petitioner that he was on inimical terms with the deceased.
Patna High Court Cr.Misc. No.1861 of 2019(2) dt.15-01-2019 2/2 Counsel for the petitioner submits that other family members have also repeated same statements before the police in paragraphs-10 and 11 of the case diary.
Petitioner is in custody since 12.9.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S.
