The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 387, 504, 506/34 of the Indian Penal Code and Section 3 (i) (x) of SC/ST Act.
It is contended that initially after registration of the FIR, the main accused Md. Sitare and Md. Parwez were granted privilege of anticipatory bail by two different coordinate Benches of this Court vide order dated 20.12.2013 passed in Cr. Misc. No.47930/2013 and order dated 18.12.2014 passed in Cr. Misc. No.45111 of 2014, copies of which have been produced at the time of hearing. It is further contended that the charge sheet was submitted against the co-accused Md. Sitare and Md. Parwez
Patna High Court Cr.Misc. No.31244 of 2016 (2) dt.10-08-2016 2/2 only, however, revisional court had remanded the matter and then cognizance has been taken against all the accused persons including the petitioner. It is urged that the matter arises out of a petty dispute of payment of fare between the driver of the Tempo and his passengers, i.e., Md. Sitare and Md. Parwez and, thereafter, ornamental allegations have been added. Having regard to the facts and circumstances of the case, let the petitioner, namely, Md. Hasrat be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Sarairanjan P.S. Case No.72 of 2013, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
