Petitioner seeks bail in Rampur Chauram P.S. Case No. 45 of 2018 registered under Sections 420, 406, 409 of the I.P.C.
The accusation is that PDS shop of the petitioner was inspected then it was found that while in the distribution register 202.45 quintal wheat and 330.16 quintal rice were shown distributed to the beneficiaries but there was no signature of beneficiaries about receiving wheat and rice. As such, this petitioner being PDS dealer has not distributed the aforesaid wheat and rice.
Learned counsel for the petitioner submits that, in
Patna High Court CR. MISC. No.23253 of 2019(2) dt.11-04-2019 2/2 fact, the alleged wheat and rice were distributed to the beneficiaries and entries were made in their ration cards but without verifying the same the petitioner has been falsely implicated in this case. He further submits that the petitioner having no criminal antecedent is in custody since 27.01.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount to the satisfaction of S.D.J.M., Arwal, in Rampur Chauram P.S. Case No. 45 of 2018 subject to the condition that one surety must be close relative of the petitioner..
