Mr.Binod Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Muffasil (Singhaul O.P) P.S. Case No. 197 of 2022 for the offence under Sections 302, 386, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.

At the very outset, learned counsel for the petitioner submits that due to over-site, the antecedent of the petitioner has not been mentioned in the petition and he is in custody since 24.04.2022.

As per the F.IR, the petitioner along with some persons assaulted the informant's son to withdraw the complaint case filed by his father. When the informant's son refused, one person, namely, Md. Mahboob set fire upon the son of the informant, as a result of which informant's son died.

Considering the fact that the petitioner has got one criminal antecedent, the petitioner, named above, is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Muffasil (Singhaul O.P) P.S. Case No. 197 of 2022. The petitioner will visit Begusarai Muffasil Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
