2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 498A, 377, 504, 509 and 34 of the Indian Penal Code.
3. The prosecution case, in brief, is that marriage of informant was solemnized with co-accused Anuj Ram one year ago as per Hindu rites and rituals. It is alleged that thereafter, all the accused persons named in the F.I.R., including this petitioner, committed torture and harassment upon the informant due to non-fulfillment of demand of dowry.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.24615 of 2025(2) dt.09-07-2025 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case merely because he happens to be brother-in-law of the victim and he is victim of over implication. Petitioner is separate in mess and property and has got no concern with the affairs of the informant and her husband. It is further submitted that during pendency of this case, good sense prevailed in between the parties and the matter has already been compromised. Husband of informant has already been granted anticipatory bail by this Hon'ble Court vide order dated 05.08.2024 passed in Cr. Misc. No. 29818 of 2024. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the general and omnibus nature of accusation, fact that husband of the victim has already been granted bail and matter has already been compromised between the parties and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named
