01-09-2016 At the very outset, Sri Ranjeet Kumar Singh, learned counsel for the petitioner, in presence of Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor, submits that due to inadvertence, an error has occurred in paragraph - 3 of the present petition. He submits that though petitioner is accused in one another case, incorrectly statement was made that petitioner has no any criminal antecedent. He accepts that besides the present case, the petitioner is accused in one another case also. The sole petitioner has prayed for grant of anticipatory bail in Khagaria P.S. Case No. 665 of 2015, G.R. No. 2489 of 2015 registered for offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act, 1959.

Patna High Court Cr.Misc. No.34426 of 2016 (2) dt.01-09-2016 2/2 Learned counsel for the petitioner submits that though it was alleged that petitioner was also present alongwith other accused persons, there is no accusation of overt act. However, keeping in view the nature of accusation, the Court is of the opinion that it is not a case for grant of anticipatory bail.

Dismissed.
