The petitioner apprehends his arrest in connection with Shyampur Bhatha P.S. Case No. 68 of 2015 registered under Sections 385 and 387 of the I.P.C. pending in the Court of S.D.J.M., Sheohar.
The accusation is of making demand of ransom of Rs. 2 lacs through mobile no. 8295810726 on the mobile of informant bearing S.I.M. No. 9955678790 on 05.12.2012 in the evening. Later on, again demand was made through the same mobile.
Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. The name of
Patna High Court Cr.Misc. No.36560 of 2016 (2) dt.17-09-2016 2/2 petitioner has come in the confessional statement of co-accused Amrendra Ram, whose name is surfaced in the C.D.R. of mobile no. 8295810726 to which ransom is said to be demanded. Having considered the facts and circumstances of the case and nature of offence, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
However, petitioner is directed to surrender before the Court below within a period of six weeks and pray for regular bail, which shall be decided on its own merit without being prejudiced by this order.
