In this case, the petitioner is seeking anticipatory bail in connection with Sitamarhi P.S. Case No.350 of 2006 (Trial No.2010 of 2016), registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code and under Section 27 of the Arms Act.

In this case, the Police has submitted the final form in favour of the petitioner, but the Court below on the basis of the material collected during investigation has taken cognizance against the petitioner.

Learned counsel for the petitioner submits that there is no allegation at all against the petitioner, but on account of

Patna High Court Cr.Misc. No.25896 of 2017 (3) dt.10-08-2017 2/2 cognizance he has moved before this Court for anticipatory bail. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for bail, the court below will pass order in accordance with law on the same day taking into considering the fact that other accused persons have been granted bail.
