Petitioners seek bail in Narhat P.S. Case No.273 of 2018 instituted for the offence under Section(s) 147, 148, 149, 341, 323, 353, 504, 506 Indian Penal Code and Section 37(i) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioners submits that allegation against the petitioners is that smell of liquor was coming from their mouth.

Petitioners are in custody since 20.10.2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.75011 of 2018(2) dt.13-12-2018 2/2 Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ADJ II cum Special Judge, Nawada, in connection with Narhat P.S. Case No.273 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.

It appears that petitioners have antecedents also under the Excise Act. The petitioners will file an Affidavit at the time of their release that they will not indulge in such activities in future, otherwise, their bail bond in the instant case will be liable to be cancelled.
