Petitioner is in custody in connection with Sherghati(Dobhi) P.S. Case No. 286 of 2019 for the offence under section395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the FIR. His name surfaced on the confessional statement.

Learned counsel submits that no one has seen the occurrence and as per prosecution case itself the miscreants tied the Gamchha on the hand and eyes of the informant to hide their identity and it is very difficult for the informant to identify the accused involved in the crime. Learned counsel further submits that the petitioner has not been put on TIP.

Considering the facts and circumstances discussed above, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner shall deposit Rs. 10,000/- cash before the court below and on deposit of Rs. 10,000/- the court below shall release the petitioner, named above, on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati(Dobhi) P.S. Case No. 286 of 2019. The amount deposited by the petitioner shall abide by final outcome of the pending criminal case.
