JUSTICE ARUN KUMAR ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

Allegation in brief is that the amount of pre-matric scholarship are being defalcated by some fictitious persons in connivance with government school officials.

Learned counsel appearing on behalf of the petitioner submits that no any such amount was ever withdrawn by this petitioner from her account. It is said that total defalcated money to the tune of Rs.15 lacs and odd has been recovered in cash in school premises and the Principal of the said School, Rajiv Ranjan

Patna High Court Cr.Misc. No.32362 of 2016 (7) dt.06-02-2017 2/2 has been granted anticipatory bail earlier by a Co-ordinate Bench of this Court by order dated 11.8.2016 passed in Cr. Misc. No.26558 of 2016.

Learned Additional Public Prosecutor appearing on behalf of the State also does not point out any material coming against the petitioner in the case diary.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let Kanti Devi, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Susri Supriya Goswami, J.M. Ist Class, Patna in connection with Gandhi Maidan P.S. Case No.118 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
