2. The petitioner seeks pre-arrest bail in connection with Patahi P.S. Case No. 110 of 2023 registered for the offence(s) punishable under Sections 392 of the Indian Penal Code.

3. As per the allegation made in the FIR, three miscreants snatched Rs.25,800/- and mobile phone from the pocket of the informant on the point of pistol and also snatched motorcycle belonging to the informant.

4. Learned counsel appearing on behalf of the petitioner submitted that FIR is against unknown and name of the petitioner has been disclosed by one co-accused Chhotu Kumar and confessional statement made before the police has

Patna High Court CR. MISC. No.25921 of 2024(2) dt.01-05-2024 2/2 no evidentiary value. No recovery has been made from the house of the petitioner in respect of stolen motorcycle and money. Petitioner has one criminal antecedent but not of similar nature and he is on bail in the said case.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation,as well as, the fact that name of the petitioner has surfaced in the present case on the confessional statement of one co-accused/Chhotu Kumar, I am of the opinion that petitioner has, prima facie, made out a case to be released on pre-arrest bail.

7. The petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Patahi P.S. Case No. 110 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) Sanjay/- U T
