Petitioner is the owner of a pick-up van bearing Registration No. BR 31GA-1275 over which huge quantity of illicit liquor was seized. Driver, Cleaner of the vehicle have been admitted to the privilege of regular bail by another Bench of this Court under Order No. 2 dated 14.07.2015 passed in Cr. Misc. No. 24781 of 2015 (Annexure2). It is submitted on behalf of the petitioner that his antecedent is absolutely clean, such statement has been made in Paragraph 8 of the petition. Let petitioner, named above, surrender in the court below within four weeks from the date
Patna High Court Cr.Misc. No.40163 of 2015 (2) dt.05-10-2015 of receipt/production of a copy of this order in the court below, thereafter be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., West Muzaffarpur in connection with Sahebganj P.S. Case No. 47/15, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. after verifying the statement made in Paragraph 8 of the petition from the case diary. Until such verification, no coercive steps be taken against the petitioner. Let this order be communicated to the court below through fax on payment of usual charges by the petitioner.
