JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Barahiya P.S. Case No. 217 of 2017 dated 20.11.2017 instituted for the offences under Sections 341, 323, 337, 452, 386, 504, 506 of the Indian Penal Code.
The petitioner is alleged to have dragged the informant out from her house by pulling her hair. It has been admitted by the informant that she had taken loan from the petitioner which she had returned but the petitioner is alleged to have demanded additional rupees fifty thousands as Rangdari.

Patna High Court Cr.Misc. No.79299 of 2018(2) dt.28-01-2019 2/2 submitted that from the F.I.R itself, it would appear that the present case has been lodged because of the petitioner demanding back the loan amount which he had given to the informant. The allegation of the petitioner using his influence to threaten the informant does not appear to be correct in the background of petitioner having clean antecedents. Regard being had to the aforesaid facts and the nature of accusation, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.S. Case No. 217 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
