The petitioners are in custody since 04.08.2018 in connection with Ujiarpur P.S. Case No.182 of 2018, registered under Sections 307, 324/34, 341 and 447 of the Indian Penal Code.

Learned counsel for the petitioners submits that the allegation against these petitioners are false and frivolous inasmuch as even the injury report is not on record in the case diary and in the entire investigation. It is further submitted that Rekha Devi, wife of Sanjay Sahni, Bhabhi of the informant, is said to have committed suicide due to family dispute and when

Patna High Court CR. MISC. No.2002 of 2019(3) dt.08-03-2019 2/2 Sanjay came to know this fact he came near his deceased wife and started weeping and in course of weeping he fell down and received injury.

Learned counsel for the petitioner submits that the entire case is concocted and the incident relating to impleading the present petitioners is also false as no injury report has been brought on record.

Considering the aforementioned facts and circumstances of the case and the nature of allegation made against these petitioners having no criminal antecedent, let the petitioner No.1, Pradeep Kumar and petitioner No.2, Kuldeep Kumar, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dalsingsarai, Samastipur, in connection with Ujiarpur P.S. Case No.182 of 2018.
