JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner no.2 being the wife of the complainant and petitioner nos. 1 and 3 being the brother-in-law (bahnoi) of petitioner no.2 are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 341, 323, 379, 384, 389, 403, 500 and 504/34 of the Indian Penal Code. It is alleged that petitioner nos. 1 and 3 misguided the petitioner no.2 and money which was taken by the petitioner nos. 1 and 3 from petitioner no.2 were not returned. Though, the matter was referred to the Mediation Centre but the issue could not be resolved.
A compromise petition has been filed to the effect that
Patna High Court Cr.Misc. No.31080 of 2014 (6) dt.28-07-2015 2/3 the complainant and petitioner no.2 have decided to part ways on payment of permanent alimony of `8 lakhs to petitioner no.2 by the complainant.
Leaned counsel for the complainant has brought a cheque of `2 lakhs being Cheque no. 400873 dated 27.07.2015 and draft of `2 lakhs being draft no.020597 dated 21.07.2015 drawn in favour of petitioner no.2 and handed it over to learned counsel for the petitioners and rest `4 lakhs have been agreed to be given one day prior to the decree being prepared in Matrimonial Suit No. 157 of 2013 filed for divorce. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Motihari in connection with Complaint Case No. 1363 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
It is expected from the learned Principal Judge, Family Court, Motihari to dispose of the Matrimonial Suit No. 157 of 2013 expeditiously in terms of the compromise. It is also expected from the learned JM, 1st Class, Motihari to dispose of the
Patna High Court Cr.Misc. No.31080 of 2014 (6) dt.28-07-2015 3/3 Complaint Case No. 1363 of 2013 in view of the present stand of the parties.
