JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-08-2015 The present writ petition has been filed for quashing of Khajekalan P.S. Case No.189 of 2013.
It is contended by learned counsel for the petitioner that there is a case and counter case and the investigating agency is not conducting the investigation of the case in a fair and impartial manner.
I find no substance in the arguments advance on behalf of the petitioner. The allegations made in the FIR do constitute a cognizable offence. The defence of the petitioner cannot be looked
Patna High Court Cr. WJC No.1204 of 2014 (3) dt.12-08-2015 2/2 into by this Court for the purpose of quashing the FIR. There is no material on the record on the basis of which this Court can give a finding that the investigation is not being carried out in a proper manner. Moreover, investigation of a police case is the exclusive domain of police. At this stage, the court has no role to play. In that view of the matter, I find no merit in the present application.
