JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bhore P.S. Case No. 147 of 2013, disclosing offences under Sections 272, 273 and 290 of the Indian Penal Code and Section 47(a) of the Bihar Excise Act. I am not inclined to entertain this application on two counts. Firstly, this application has been filed more than two and half years after the date of occurrence. Secondly, the petitioner is accused in at least three cases;
Patna High Court Cr.Misc. No.29239 of 2016 (2) dt.20-08-2016 2/2 two of them are under the provisions of the Bihar Excise Act.
This application is, accordingly, rejected.
The petitioner, above named, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
