ANJANA MISHRA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 419/420/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that, in place of himself, one Rohit Kumar is found to be appearing in the matriculation examination being held on 15.03.2016. He submits that neither the admit-card nor any document belonging to the petitioner has been recovered from the person of the said Rohit Kumar. So far as the petitioner is concerned, he has no knowledge about any such person nor is the said Rohit Kumar known to him.

No.27617 of 2016 (2) dt.09-08-2016 P2/2 Considering the aforementioned facts and circumstances and also that co-accused Guddu Kumar who was also one of the co-accused, has been extended the privilege of anticipatory bail vide order dated 30.05.2016 passed in Cr. Misc. No. 23973 of 2016, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No. 57 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
