JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending his arrest in a case instituted under Section 498(A) and other allied Sections of the Indian Penal Code.
The allegation against the petitioners is of assaulting and torturing to the complainant for non fulfillment of additional dowry.
On behalf of the petitioners it has been submitted that petitioner no.1 is the husband of the complainant and petitioner no.2 is the Dewar of the complainant. It has been submitted on behalf of the petitioner no.1 that he is ready to deposit an amount of Rs. 1500/- every month in the court below,
Patna High Court Cr.Misc. No.39657 of 2014 (5) dt.29-07-2015 2/2 which shall be released in favour of the complainant. On behalf of the State, it has been submitted that the petitioners are named in the complaint petition. Considering the aforesaid facts, let the above named petitioner no.1 is directed to deposit an amount of Rs. 1500/- every month in the court below, which shall be released in favour of the complainant.
Let, in the event of their arrest or surrender in the court below within a period of four weeks, the petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M.,Supaul, District- Supaul in connection with Complaint Case No. 399 ( C ) of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
