2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 373/34 of the Indian Penal Code and Section 5/6 of Human Trafficking Act.
3. Allegation against the petitioner along with other co-accused persons is that they induced the minor daughter of the informant and abducted her with an intention to sell her.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has
Patna High Court CR. MISC. No.23212 of 2025(2) dt.29-04-2025 2/3 falsely been implicated in the present case. There is no eye witness of the alleged offence. There is inordinate delay of 10 days in lodging the F.I.R. Victim girl was recovered at Aligarh. It is further submitted vide para 10 of the petition that as per statement of the victim, she went to Aligarh through public transport which shows hat she herself went with the petitioner. Trial has been proceeded in this case. Moreover, the petitioner is languishing in judicial custody since 20.04.2024. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused Jugiya Devi @ Juli Devi has been granted bail vide order dated 15.02.2025 by the co-ordinate Bench of this Court.
5. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner
Patna High Court CR. MISC. No.23212 of 2025(2) dt.29-04-2025 3/3 on bail. The above named petitioner is directed to be enlarged on bail in connection with Goradih P.S. Case No. 19 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XIX, Bhagalpur.
