Petitioner seeks regular bail in connection with Bibhutipur PS Case No. 378/2020 registered for the offence punishable under Sections 341, 323, 307, 385, 504, 354, 354(B), 379/34 of the IPC.

The allegation against the petitioner, as per First Information Report, is that the petitioner, allegedly, assaulted the informant on his head by means of iron rod. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and both the parties are co-villagers and there was some dispute with regard to payment

Patna High Court CR. MISC. No.34226 of 2021(3) dt.23-02-2022 2/2 of money between them. He further submits that petitioner is in custody since 25.02.2021, charge-sheet has been submitted in the matter and there is no likelihood that the petitioner will abscond or will tamper with the evidences.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner having no criminal antecedent is in custody since 25.2.2021, charge-sheet has been submitted in the matter and the trial is not likely to be conclude in near future due to pandemic, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, ARBIND SAHNI @ ARVIND SAHNI be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 2nd Rosera, Samastipur in connection with Bibhutipur PS Case No. 378/2020.
