2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 411 and 34 of the Indian Penal Code .

3. As per the prosecution case , a raid was conducted against the illegal transporting and storage of the sand and it was found that 700 cubic feet sand and 2200 cubic sand were stored in different places. It is further alleged that the local persons have disclosed the name of this petitioner and coaccused Kundan Kumar who were involved in the aforesaid illegal storage and transportation and due to this they also

Patna High Court CR. MISC. No.26164 of 2024(4) dt.10-07-2024 2/2 caused revenue loss of Rs. 74375/- and Rs. 2,33,750/- to the government.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . He is neither owner nor driver of the vehicle in question .

5. Learned counsel for the State opposes the prayer for bail ans submits that petitioner is named in the F.I.R., and he has got five criminal antecedents of similar nature .

6. Considering the criminal antecedents of the petitioner and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected.
