JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sakra P.S. Case No. 317 of 2015 registered under Sections 272 and 273 of the Indian Penal Code and section 47 (A) of the Excise Act The accusation is that in course of raid of the house of the petitioner no.2, 125 pouches, each containing 200 ml., country made liquor recovered beneath the Chowki of petitioner no. 2, 4 bottles, each containing 375 ml., 60 bottles, each containing 180 ml. Foreign Liquor, also recovered from the rack of the petitioner no.1.

No.33279 of 2016 (2) dt.20-08-2016 2/2 petitioners submits that it would appear from the seizure list that copy of the seizure list has not been handed over to the family members of the petitioners at the time of search and seizure. It is also submitted that petitioners have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Muzaffarpur in connection with Sakra P.S. Case No. 317 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
