The petitioner apprehends his arrest in Birpur P.S. Case No. 42/2017, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and sections 27(b)(ii) of Drugs and Cosmetics Act.

The informant alleged that some medicines were recovered by the side of the shop of the petitioner and petitioner was selling the medicines illegally.

It is submitted that the petitioner has got license and no spurious medicines was recovered from the possession of the petitioner or from the premises of the petitioner. Considering the facts aforesaid and the fact that petitioner have got valid license for selling medicines, the
