The petitioners are in custody in connection with (FIR No. 17 of 2019) registered at Rohtas P.S. Case No. 17 of 2019 for the offences under Sections 379, 411/34 of the Indian Penal Code and Section 4/40 of Mines and Mineral Act, 1972 and Section 3, 6, 8 of Bihar Mines and Minerals Transportation Act, 2003.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and they are in custody

Patna High Court CR. MISC. No.22329 of 2019(2) dt.08-04-2019 2/2 since 18.01.2019. He further submits that allegation against the petitioners is that they were involved in illegal mining of sand. Considering the fact that petitioners have no criminal antecedent, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Sub-Divisional Judicial Magistrate, Dehri in connection with Rohtas P.S.
