JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioner apprehends his arrest in connection with Taraiya P.S.Case No. 84 of 2018 registered under Sections 307, 353, 413 and 414/34 of the Indian penal Code. Allegation, as per the FIR is that on the information that some criminals have assembled, the police raided the place and they fired on the police and two persons were arrested and others succeeded in fleeing away. Petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that he has been named by co-accused and except that, there is no allegation of firing against him and he is no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court Cr.Misc. No.78967 of 2018(3) dt.23-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IX, Saran at Chapra in connection with Taraiya P.S. Case No. 84 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
