JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Aurangabad (Town) P.S. Case No. 145 of 2016 registered under Section 414/34 of the Indian Penal Code.

The accusation is that in course of checking, two persons were seeing on a motorcycle, who came towards Ramabandh, on which, informant signaled him to stop the motorcycle but the one person, who was sitting on the back side of motorcycle, succeeded to flee away and one another, who was driving motorcycle, was apprehended by the police, who disclosed his name as Sukesh Choudhary and also disclosed the name of

Patna High Court Cr.Misc. No.36485 of 2016 (2) dt.07-09-2016 petitioner, Satyendra Choudhary, saying that he along with petitioner used to commit theft of motorcycle. Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended at the spot rather his name has been disclosed by Sukesh choudhary except that there is nothing against the petitioner showing the involvement in the present case. It is further submitted that petitioner has no criminal antecedent. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case No. 145 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
