JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This is an application for grant of anticipatory bail in connection with Hajipur Sadar P.S. Case No. 581 of 2018, disclosing offences under Sections 147, 149, 384, 379, 427 of the Indian Penal Code.

Allegation against the petitioners is of damaging the boundary wall of the informant and also demanding extortion from him.

Submission of learned counsel for the petitioners is that land dispute is going on between the parties and a partition suit is also pending, which the petitioner have stated in para 8 of this petition. Further, they have no criminal antecedents. Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 581 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
