Mr. Ram Anurag Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 17-06-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Adapur P.S. Case No. 358 of 2025, instituted under Sections 126(2), 115(2), 117(2), 118(1), 303(2), 109, 74, 351(2), 352, 3(5) of the B.N.S.

3. As per the prosecution case, informant had sold her land and house to the mother of her villager, namely, Sukesh Kumar. On 24.09.2025, when Sukesh Kumar was cleaning the

Patna High Court CR. MISC. No.24590 of 2026(3) dt.17-06-2026 2/3 land, F.I.R. named accused persons including the petitioners armed with weapons came there and said Sukesh Kumar to vacate the land. On protest, accused persons assaulted Sukesh Kumar. When the informant came to save him, Petitioner Nos. 1, 3 and 4 assaulted her due to which she became unconscious. It is alleged that Petitioner No. 2 snatched golden chain worth Rs. 1 lakh from the neck of informant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Injuries to the injured are simple in nature. Injury reports do not substantiate the allegation levelled against the petitioners. Both parties are neighbours and there is land dispute between them. Petitioner Nos. 1, 4 and 5 have no criminal antecedent whereas Petitioner Nos. 2 and 3 have one criminal antecedent. Petitioners undertake to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and nature of allegation, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners, abovenamed, be released on bail upon furnishing bail bonds of Rs.
