The petitioner apprehends his arrest in connection with Kutumba P.S. Case No. 127 of 2022 registered under Sections 379, 411 of the Indian Penal Code, Sections 4, 21 of the Mines and Minerals Act, Sections 11, 43 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules and Section 56 of the Bihar (Concession, Prevention of Illegal Mining, Transportation & Storage) Amendment Rules.
Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused persons have already
Patna High Court CR. MISC. No.27212 of 2023(2) dt.07-07-2023 2/2 been allowed bail by a Co-ordinate Bench of this Court vide order dated 31.01.2023 passed in Cr. Misc. No. 53724 of 2022. Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Kutumba P.S.
