JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code.

On the alleged date and time of occurrence, the informant was sitting at his door when the FIR named accused persons including the petitioner armed with weapons came there and assaulted the informant and one Vikki Prasad. It is further alleged that all the accused persons entered the house of Vikki Prasad and looted some articles and cash.

It is submitted on behalf of the petitioner that the allegation of assault against the petitioner is general and omnibus. There is no specific over-act leveled against the

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 125 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
