The petitioner seeks bail in connection with Begusarai Town P.S. Case No. 254 of 2018 registered under Sections 25(1-b)a, 26, 35 of the Arms Act.

One country made pistol and mobile phone are said to have been recovered from joint possession of the petitioner and Rahul Kumar from their rented room. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized articles. Though, he has been residing

Patna High Court Cr.Misc. No.79267 of 2018(2) dt.18-01-2019 2/2 in the room in question, but he had no knowledge of keeping of firearm by his roommate in the said room. Moreover, no cartridge has been recovered from the said room and without any cartridge, the firearm is useless. Though, one more criminal case has been lodged against the petitioner, but he is on bail in the said case. He has been languishing in custody since 5.05.2018.

Learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 254 of 2018.
