ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned A.P.P. appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Kotwali (Adampur) P.S. Case No.214 of 2016 registered for the offences punishable under Sections 406, 420 and 506 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the entire allegation is false and fabricated and has been drawn up only because the petitioner, who had left the Company in February, 2016, had been demanding his wages for the past two months. It is further submitted that though the entire allegation is of the month of February, 2016, but the F.I.R. in the present case was lodged in the month of May, 2016 and for the

Patna High Court Cr.Misc. No.27625 of 2016 (2) dt.20-08-2016 said delay, no plausible explanation has been offered by the informant.

Considering the nature of allegation made and that there is unusual delay in lodging the first information report as also the petitioner has got clean antecedent, let the petitioner, in the event of his arrest or surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each in connection with Kotwali (Adampur) P.S. Case No.214 of 2016 to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
