Petitioners apprehend their arrest in Mahila P.S. Case No.157 of 2018 registered under Sections 354(D)/420/34 of the Indian Penal Code and under Sections 3⁄4 of the Dowry Prohibition Act.
The informant alleged that her ring ceremony was performed on 22.06.2018 after settlement of her marriage with Sunil Kumar. On 24.08.2018 the family members of the informant went to the house of the bridegroom but the petitioners who happens to be mother and sister-in-law of the bridegroom along with others abused and demanded additional dowry.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.79146 of 2018(2) dt.25-01-2019 2/2 petitioners did not take any part in the negotiation for settlement of marriage. Ring ceremony was performed but thereafter some differences arose between the informant and bridegroom for that the informant lodged the case implicating all the family members of the bridegroom.
Having considered the facts aforesaid and nature of allegations made against the petitioners and the fact that petitioners are mother and sister-in-law (Bhabhi) of the bridegroom, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Patna in connection with Mahila P.S. Case No.157 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
