Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Balia P.S. Case No. 221 of 2022 registered for the offence under Section 25(1-b)A, 26 and 35 of Arms Act.

As per the prosecution story the informant police officer recorded his self statement alleging that namely Dhiraj Kumar disclosed that the co-accused, driver of the pick up vehicle and other accused persons had shown him pistol and threatened to him. Thereafter, the driver of the pickup vehicle bearing registration No. BR 09 GB 7119 disclosed that he and other named co-accused persons and 2-3 unknown companion

Patna High Court CR. MISC. No.24000 of 2023(2) dt.18-05-2023 2/3 had looted the pick up vehicle loaded with vegetables and fled away with the vehicle in which Khalasi was also present, The Khalasi was ousted from the vehicle on point of pistol. He further disclosed that they had concealed the arms in the pickup vehicle beneath the seat. Thereafter, on instance of the coaccused the vehicle was searched and a country made pistol loaded with live cartridge was recovered.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.12.2022 and nothing incriminating article were recovered from the possession of the petitioner.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Begusarai/concerned Court below in connection with Balia P.S. Case No. 221 of 2022.

The petitioner will visit Mansoorchak, Begusarai

Patna High Court CR. MISC. No.24000 of 2023(2) dt.18-05-2023 3/3 Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
