2. The petitioner has preferred this application for grant of regular bail in connection with Ramgarh P.S. Case No. 14/2024 dated 16.01.2024 registered for the offences punishable under sections 302, 34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, on 15.01.2024 at about 5:30 P.M., the informant's wife had gone to the house of Manish Singh for taking tea. After sometime the sound of firing was heard, the informant went to Manish Singh's house and took torch as there was darkness in the passage. The informant along

It is further alleged that on 15.01.2024 at about 6:30 P.M. the petitioner who was hiding in the house of his brother, shot the informant's wife dead near the house of Rama Shankar Singh due to previous dispute for which she was also threatened to kill by the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case mere on suspicion. There was a dispute between the deceased and the petitioner regarding election of Up-Pramukh and M.L.A. There is no eye-witness of the incident and the case of prosecution is based on the statement of the husband of the deceased who came to the spot with torch but no body was seen by him. It is further submitted that there was darkness at the time of the alleged occurrence. The occurrence took place near the house of Rama Shankar Singh who came out of his house on hearing sound of firing but he did not see anyone.The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 30.01.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as finding substance in the contention of learned counsel for the petitioner as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Kaimur at Bhabua, (Mohania) in connection with Ramgarh P.S. Case No. 14/2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
