The petitioner, who is in custody since 04.01.2020 seeks bail in connection with Barauni (Chakiya) P.S. Case No. 4/2020 dated 03.01.2020 [G.R. No. 11/2020] instituted for the offences under Sections 353, 307, 379, 511 and 34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The petitioner and four others are alleged to have been cutting electric wire when the police party apprehended

Patna High Court CR. MISC. No.21834 of 2020(2) dt.08-07-2020 2/2 them. Firing was resorted to but admittedly nobody appears to have been injured. From the possession of one Satish Kumar, one loaded country made pistol and live cartridge was recovered. From the house of one of the arrested accused persons, electric wire also was recovered. There is no recovery from the possession of the petitioner and he is a person of clean antecedent.

Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Chakiya) P.S. Case No. 4/2020, [G.R. No. 11/2020].
