JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-04-2024 The present writ petition has been filed seeking the following reliefs:- "1. (I) Issuance of an appropriate writ including a writ in the nature of Mandamus commanding and directing the respondents to forthwith grant and pay all the benefits of Assured Career Progression (In short A.C.P.) to the petitioner 2nd A.C.P. with effect from 28/01/2009 and 3rd A.C.P. with effect from 28/01/2019 to which he is eligible and entitled to get the said benefits on completion of twenty years of service and thirty years of service on the basis of Notification dated 14/07/2010

Patna High Court CWJC No.5995 of 2024(2) dt.25-04-2024 2/3 issued by the Finance Department, Government of Bihar and also pay the benefits of revision of the pay scale with effect from 01/01/2006 on the basis of Sankalp Gyap No. 3A-2Ve. Pu16/09-630 dated 21/01/2010 issued by the Finance Department, Government of Bihar and other benefits.

(II) Issuance of an appropriate writ in the nature of Mandamus commanding and directing the respondents to release all the consequential benefits to the petitioner upon sanction of Second A.C.P. and 3rd A.C.P. and further to be pleased to direct the respondents to forthwith revise and pay all the related benefits consequent upon such promotion. All such Financial/ Monetary benefits be kindly ordered to be paid with interest at the rate of 18% P.A. and to grant all the consequential benefits upon sanction of the A.C.Ps and revised pay with interest at the rate of 18%."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no. 2 i.e. the Collector-cum-District Magistrate, Banka for redressal of his aforesaid grievances. Liberty, so

It is needless to state that in case the petitioner approaches the respondent no. 2 i.e. the Collector-cum-District Magistrate, Banka, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed of by a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter. 4.

The writ petition stands disposed of on the aforesaid terms.
