JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 401/34 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act. As per the prosecution case, police apprehended two miscreants and recovered a cartridge, country made pistol and mobile phone. They disclosed name of the petitioner who managed to flee away on motorcycle.

Learned counsel appearing for the petitioner submits that petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.23764 of 2023(2) dt.27-06-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Turkauliya Police Station Case No. 575 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
